Successful Defense for Trucking Company & Driver Jury Finds in Favor of Hermes Sargent Bates Defendants

Hermes Sargent Bates partner Monte Hurst and associate Blake Riordan successfully represented Crete Carrier Corporation, one of the largest trucking companies in the country, and its driver in a personal injury lawsuit. On May 16, the Dallas Country jury returned a unanimous verdict in favor of the defendants.
The plaintiffs, a husband and wife who were involved in the collision with the tractor-trailer, sued the trucking company and its driver, alleging that the truck driver had negligently reversed his truck into the plaintiffs vehicle while attempting to correct his passage through a u-turn lane.
At trial, the defendants demonstrated that the truck driver had followed the proper procedure in reversing his truck. They also argued that the husband, who was the driver of the vehicle, failed to take precautions to avoid the collision, in fact causing the collision by improperly attempting to pass the rear of the truck while it was in reverse.
After a two-day trial, the jury returned a unanimous verdict in favor of the defendants, finding that the husband was responsible for the accident and that the plaintiffs were not entitled to any damages.
