11, 2nd Chance 4 Pets has launched a national campaign to promote adopting orphaned pets from shelters. Over 500,000 pets are orphaned each year due to the death or disability of their human companions. 2nd Chance 4 Pets is the first organization to focus their efforts on this long, unrecognized issue, and Adopt an Orphaned Pet Day is helping to create awareness and reduce the numbers of companion animals needlessly euthanized throughout the US each year.

Adopt an Orphaned Pet Day has been established in tribute to the 800 pets that were orphaned on 9/11 in New York City and their human companions who tragically died. Fortunately, animal rescue groups across the country joined forces to find new homes for these pets. Unfortunately, there are not enough resources to currently help find homes for all 500,000 pets that become orphaned each year when their owners die.

2nd Chance 4 Pets is exposing the problem of pets being relinquished and euthanized due to their human companionsÂ’ death or disability. Pet owners predecease their pets due to natural and man-made tragedies - hurricanes, fires, floods, car accidents and even terrorism. Unfortunately, there are 500,000 reasons for pet owners to plan for the lifetime care of their pets while they are able to make such important decisions.

“Most responsible pet owners are not aware of the planning options that are available to ensure continuous care for their pets”, says Amy Shever, Director of 2nd Chance 4 Pets. “Our organization is helping pet owners plan for the lifetime care of their pets by assisting them with establishing emergency plans, and encouraging them to select other caregivers who are committed to caring for their pets.”

“575 dogs and cats were put to death is US shelters every hour last year,” says Cyrus Mejia, artist and creator of The Best Friends Animal Society Art Project, a memorial to these pets. “Since many of these animals are healthy and adoptable the efforts of 2nd Chance 4 Pets have tremendous potential to significantly reduce these numbers. It will guarantee life for pets that have provided constant love and companionship.”

In California alone, animal control agencies and shelters euthanize an estimated 750,000 to 1 million dogs and cats annually to deal with the surplus of companion animals. This method of animal control costs California taxpayers in excess of $50 million annually (Assembly Bill 2513). Spay and neuter programs represent the most successful organized prevention strategy to reduce the number of pets relinquished to animal shelters each year. These programs have reduced unwanted breeding and population, but the numbers of pets still being euthanized throughout the country is still at epidemic levels.

“The tragedy of 9/11 forced many of us to realize that we need to plan ahead for the care of all aspects of our lives – including our pets,” explains Jane Hoffman, President of the Mayor’s Alliance for NYC's Animals. “We are encouraging pet owners to make sure that should anything happen, their pets are cared for. Do we work to live or do we live to work? The answer is “both.” We need to work in order to provide for our families and ourselves. We also work for personal fulfillment. All humans need the sense of accomplishment that comes from a job well done.

Things go awry when our personal and working lives go out of balance. Not that itÂ’s possible to maintain a state of equilibrium at all times; sometimes itÂ’s necessary to spend a period of time highly immersed in one area of your life or the other. The operative phrase is a period of time. LetÂ’s face it; the working world is much more demanding than it ever has been. Hours worked per week have been creeping up and days of vacation taken have been shrinking.

So what's a person to do? To maintain balance, I recommend that you develop specific goals and priorities set around areas of your life that are import to you. Don’t just say, “I want to spend more time with my kids.” You have to be much more specific if you are going to succeed. What are your personal objectives or goals for the day, week, month or year? Are you scheduling time to focus on your family, friends, hobbies and, importantly, your health?

I am the father of three daughters, a husband, a gainfully employed executive of a large publicly traded company, an author and a public speaker. Time is a precious commodity to me – one that I take care to manage precisely.

So, for example, my wife and I actually sit down to do weekly planning together. After all, my wife depends on me to free up time for her as much as I depend on her to help me – though I have to admit she does most of the heavy lifting for the family. We also plan our two family vacations a year and get them on the calendar in January, if we can.

Sometimes the common sense, the simple approach, can be the best approach. Maintain a weekly/daily to-do list. You can do it on your computer or do it the old fashioned way – hand written on lined notepaper. Better yet, use a journal that will become a permanent time management record.

Creating the list brings some needed discipline and organization to the tricky life-work balancing act. It will become a routine exercise that will allow you to not only organize your time but – and this is important – to prioritize your time commitments. If you find yourself with more than five MUST-do items for a given day, chances are they’re not all must do items.

As basic as this is, itÂ’s amazing how well it works. I look at my to-do list often and try to remain focused on it. By the end of the day, I usually have the must-do items accomplished.

Keep in mind, however, that quite often your gut instinct can be a more reliable measure of work-life balance than your reasoning mind. Most of us tend to rationalize an imbalance when we look at things from a “logical” perspective. Why? Because we either don’t want to face issues in certain areas of our lives or because we’re doing what we think we should be doing according to some unrealistic standard. It pays to take a few minutes every week to clear your head, review your business and personal lives – and listen to what your gut has to say.

Joined by a bevy of Hollywood's most visible environmental activists, an alliance of leading ocean conservation groups today released a Public Service Announcement supporting the establishment of Marine Protected Areas (MPAs) along the Southern California coast.

Heal the Bay, Surfrider Foundation, Save Our Coast and Shifting Baselines produced the PSA, which features actor PIERCE BROSNAN and wife KEELY BROSNAN, "Scrubs'' stars JOHN C. MCGINLEY and CHRISTA MILLER, Heal the Bay board member and actress AMY SMART, fashion model/pro volleyball player GABBY REECE, EDIE MCCLURG ("Ferris Bueller's Day Off"), and SIMON HELBERG ("The Big Bang Theory").

MPAs are areas of the ocean set aside as safe havens to conserve marine life and their habitats. By sheltering ocean wildlife from exploitation, studies show their populations are able to rebound. Just as national parks have been created on land to preserve nature, the creation of MPAs will protect the special places in the underwater world.

"Marine Protected Areas are an absolutely critical strategy in protecting California's coastal oceans for future generations," said Mark Gold, D. Env., president of Heal the Bay. "Our campaign conveys a clear and powerful message: California is creating MPAs for one simple reason -- MPAs work."

California officials have been working to institute MPAs along the California coast since the Marine Life Protection Act was passed in 1999. The law requires the establishment of a statewide network of MPAs to protect habitats and marine life populations. The open and transparent process is guided by recommendations from scientists, resource managers, stakeholders and members of the public.
"For years people have been saying to us, 'Enough with the problems, we want to hear about solutions,'" said Randy Olson, Ph. D., director of Shifting Baselines and creator of the "MPAs Work" campaign. "Now we can finally say to them, 'We have an answer: MPAs, and they work.' "

The process of creating MPAs in the Southern California region from San Diego to Santa Barbara, is now in its final stage. The PSA aims to raise awareness about the benefits of MPAs and to encourage public participation in determining their boundaries.

The PSA directs the public to visit MPAsWork. org. Visitors are invited to send letters of support, attend public meetings, and learn more about the process of establishing MPAs. The state plans to announce its final list of Southern California MPAs in December.

New York City divorce, custody and appellate lawyer Lisa Beth Older, Esq. appeared on Fox Five News on July 9, 2010 to provide legal analysis for a television segment on the latest Court ruling on Gay Marriage, commenting on the Federal Ban against gay marriage and the Judge who called the ban unconstitutional.

On July 8, 2010 the United States District Court Judge Joseph Tauro, appointed to the Court by Richard Nixon, struck down DOMA, or the Defense of Marriage Act, as unconstitutional as applied to Massachusetts. ( Mass. v. US Dept of Health, et al., Civil Action No. 1:09-11156-JLT). DOMA was struck down because the law failed to provide equal protection of the law for gay and lesbian couples (http://www. nycdivorcelawyer. net) and because it impinged upon a States' right to define marriage, stripped the States of the right to legislate under the 10th amendment to the constitution, and disallowed the State from equally distributing federal funds amongst its citizenship, thus invoking invidious discrimination against its citizens.

The Federal Ban against gay marriage codified as the "Defense of Marriage Act" or referred to as "DOMA", was enacted by the Clinton Administration in 1996.

The act of the Federal District Court in striking down DOMA lends strong support to gay and lesbian couples in their legitimate quest to have equal rights, and to also have equal access to New York Courts for the purpose of seeking relief as to their children in disputes involving custody visitation, child support and divorce rights (http://www. nycdivorcelawyer. net) attendant to same sex marriages performed in alternate States.

"Under the current law known as DOMA, the federal government does not recognize same sex unions" says New York City divorce lawyer Lisa Beth Older, Esq. "DOMA narrowly defines marriage, and derivative parentage rights, as a union between a man and a woman." DOMA states that parties to a same sex unions shall not be allowed to take advantage of federal benefits and protections given to and enjoyed by heterosexual couples. Examples of the kind of benefits prohibited to gay and lesbian couples are the benefits derived from any Federal program, such as being allowed to sign of joint tax returns, being allowed to receive health insurance benefits, having federal burial rights for surviving spouses of a deceased gay and lesbian service man or service woman, and other such federal benefits stemming from federal employment. While DOMA does not expressly preclude States from passing their own laws affirming gay and lesbian marriage, DOMA does expressly allow a State to not recognize a same sex marriages performed in alternate State that has in fact legalized gay and lesbian marriage. The legitimacy of DOMA affects all gay and lesbian couples in Iowa, Connecticut, Massachusetts, New Hampshire and Vermont, along with the District of Columbia.

The lawsuit against the legitimacy of DOMA was filed by the Gay and Lesbian Advocates and Defense group, and a second companion case was filed by the Commonwealth of Massachusetts in the Federal District Court.

The Obama Administration is likely to appeal the law to the United States Circuit even though he campaigned for president in favor of repealing DOMA. Obama will need to make a tough decision soon.
Proponents of the law say that the Justice Department is bound to enforce and defend laws of the land.

Presently there are five States that recognize gay and lesbian marriage, those being New Hampshire, Vermont, Connecticut, Massachusetts, Iowa, as well as the District of Columbia. This ruling will likely have gay and lesbian couples rallying for similar law suits against DOMA in their respective States.

Thus, if Obama decides to appeal the ruling to the United States Circuit Court, and if the higher Court agrees with Judge Tauro's ruling then, and if the Justice Department appeals that holding as well the case will likely go all the way to the United States Supreme Court. If DOMA is found unconstitutional. there, then DOMA will no longer be the law of the land. If the opposite result appertains, and DOMA withstands the legal challenge, then DOMA still prevails and the ban against gay and lesbian marriage will be stronger than ever. This is a frightening prospect for gay and lesbian couples across the board who deserve equal protection under the law.

Gay and lesbian Marriage has been recognized in Massachusetts since 2004. Now that a Federal Judge has struck down DOMA, gay and lesbian spouses or couples of same sex unions will now be allowed to apply for federal benefits, this only after the automatic fifteen (15) day automatic Stay lapses and absent any newer stays by the Circuit Court. This ruling will open the flood gates for legal action by gay and lesbian citizens of States that have legalized same sex marriage.

Lisa Beth Older, Esq. opines that the Federal ruling will also likely affect gay and lesbian custody rights. Where there is marriage, there is divorce. As such, it will be interesting to see what effect if any the ruling of the Federal Court striking down the Defense of Marriage Act will have on New York Family Court cases.

The Federal Court ruling will have an impact on gay and lesbian disputes in New York. "The New York Court of Appeals is charged with dealing with problems of law stemming from paternity, child support, custody and divorce" says New York appellate and divorce lawyer Lisa Beth Older. At present, New York does not recognize gay and lesbian marriage and divorce and in many instances limits standing of gay couples to sue in family court. However, in a recent series of cases coming down from the New York Court of Appeal in May 2010 the New York's highest Court has begun to seriously grabble with the problem of how to deal with children of gay and lesbian marriages or gay and lesbian unions in custody and support cases.

Prior to May 4, 2010, if a child of a New York same sex couple was conceived through artificial insemination, and if the subject child of that union was not adopted by both gay and lesbian parents in New York, then the non-adoptive, non - biological parent had no standing to sue for custody and visitation (http://www. nycdivorcelawyer. com), and the biological parent had no responsibility to provide child support for the child. Now, the law as to child support and gay couples has changed dramatically. As of May 4, 2010 the Court of Appeals, in the Matter of H. M. v. E. T held that a same sex partner may sue a non-biological partner for child support, regardless of the lack of adoption or biological ties. This holding broke new ground for Gay and lesbian rights by expanding the notion of parentage beyond the borders of heterosexual couples with an emphasis on the child's attachments and on the "best interest of the children." There, the Court of Appeals recognized the right of a gay and lesbian woman to sue for child support in Family Court as against a same sex parent. This ruling has large consequences as it gives the State Courts power to define who is a parent for purposes of child support.

As to the rights of gay and lesbian couples to sue for custody, the New York Court of Appeals is not as liberal. The holding in the Matter of Alison D. v. Virginia M. (77 N. Y.2d 651, 1991) stated that New York parenthood requires that there be a biological or adoptive relationship between parent and child before custody may be asserted. However, the Court of Appeals in May 2010 diverted from this position, at least in part. While reviewing a New York lower court holding on a visitation case involving a same sex marriage of Vermont, the case of Debra H. v. Janice R (Court of Appeals May 4, 2010, NY slip opinion 0375), the Court held that New York must now recognize Debra H.'s parental status under the law of Vermont.

Lisa Beth Older states that "the case of Debra R. is just start. More must be done by the legislature and the Courts in interpreting these laws of access to Family Court through the prism of the United Stated Constitution." Holding on to the last vestiges of Matter of Allison, supra, the Court held that while New York still does not recognize a gay and lesbian parent's right to sue for custody of their child absent an adoptive or biological relationship to the child, if the child is born of a legally recognized same sex marriage in another State where same sex marriage is legal, that parent may indeed sue for custody. This may be a step in the right direction.

Accordingly Judge Taro's federal ruling banning the Federal government from legislating unequally between gay and lesbian and heterosexual couples, by giving rights to heterosexuals without giving equal rights to gay and lesbian couples bears on New York State's power to overrule and strike down any State law that unconstitutionally fails to provide equal access to the Courts, equality, due process of law, and justice to all of its citizens. The Federal holding will serve as a platform to empower New York State Courts to start providing all couples, gay and lesbian alike, equal access and standing to utilize the Courts for purposes of suing for custody, visitation and child support. This ruling would allow brave Courts throughout this country to challenge State laws that discriminate against one set of parents while allowing other parents to have access to the court system to secure their rights of access to gay and lesbian parents.

The Federal District Court holding, while only relevant to Massachusetts, supports the notion that State and Federal governments may not pass and enforcing laws that discriminate against some of its citizens, while providing government benefits to other groups of citizens. By way of deduction, this holding would support the fact that both Federal as well as State governments should not pass and enforce laws that deny equal access to the Courts. Under the Constitutional provisions of equal protection of the law, all citizens, whether they be gay, lesbian or heterosexual must be afforded equal and identical benefits of due process of law through access to our State Courts for the purpose of disputing custody and visitation claims. Derivatively all children would benefit from a proactive Court whose aim is to protect innocent children, whether they be the product of gay or heterosexual couples. 

Empowered by this recent Federal Court decision of July 8, 2010 New York Courts might venture forth toward striking down discriminatory laws that preclude gay and lesbian parents from suing for custody and visitation in the absence of a biological or adoptive connection to the child. "Presently, in a custody dispute between same sex partners, where there is no adoption or legally recognized gay marriage, the biological parent will prevail over the non-biological parent, absent adoption or a legally recognized marriage performed in another state" says New York attorney Lisa Beth Older, Esq. As to the effect DOMA has on children of gay couples, it is reprehensible, because custody disputes inevitably ends with a child losing the very active involvement of one of the parents.

Proponents of the Defense Of Marriage Act argue that it is not up to a Court to write the law as to gay and lesbian marriage. In large part, New York State Courts still adhere to the same principal, but have shown bravery in its latest progeny of cases.

The Physiology of Hair Loss

Methadone use has increased in pain management and drug replacement therapy for addicts despite hundreds of people dying each year from black market use.

The Substance Abuse and Mental Health Administration’s Drug Abuse Warning Network reported that more than 10,000 people turned up in emergency rooms after having abused methadone in 2001, which is double the number from just two years earlier.

Reported deaths from methadone abuse are rising in North Carolina, Florida, West Virginia, Maryland, Montana and Nevada while it has become the deadliest drug in Oregon according to state medical examiners. Meanwhile, profits for the drug’s manufacturer and dispensers have increased dramatically as well.

Methadone was developed by German chemists as a painkiller during World War II and has been widely used as drug replacement therapy to get addicts off heroin and other opiates. There are currently more than 1,200 facilities that dispense methadone to addicts, totaling approximately 200,000 patients. While methadone may not produce the same high as heroin or Oxycontin, it is more physically addictive and more difficult to withdraw from.

The Drug Abuse Treatment Outcome Studies (DATOS) issued a report on a multi-city study of status of patients before and after various types of treatment, including outpatient methadone treatment. The results of this study that was done in the 90’s showed that there was actually a slight increase in heavy alcohol use among methadone patients, but perhaps the most obviously overlooked flaw in this type of treatment is that the addicts are still on drugs, and this cannot be considered rehabilitation.

A new documentary called “Methadonia” is to be aired on HBO that follows the lives of several methadone patients, including one who has been on the drug for 30 years.

According to J. J., a 30 year-old former heroin addict from Michigan, “I was on methadone for 5 years and it was much harder to get off than the heroin. You can’t skip a day going to the [methadone] clinic or you immediately get really sick. It’s a trap either way.”
